I am writing to express concerns with your draft regulatory concepts for implementing a Carbon Capture, Removal, Utilization, and Storage (CCUS) Program per the direction of SB 905 (2022, Caballero).

The development of CCUS poses significant costs, risks, and dangers to communities and should not move forward. California has significant challenges for safely storing carbon dioxide, including seismicity, wildfires, and numerous old and abandoned wells, which compound risks in our state. CARB has yet to demonstrate that CCUS can be done safely, given these specific California concerns, and should do so before developing any regulations that would allow for the perpetuation of this industry in our state.

I am submitting the following comments to help reduce inherent harms to our climate, health, and environment from proposed CCUS development across California.

- We live in an earthquake state, and when carbon storage projects fail, people can literally begin to suffocate.

- Seismic monitoring must be more robust, and the emergency remedial response plan is insufficient to protect communities.

- In addition to being dangerous and potentially deadly, these projects are exceedingly expensive. The state and taxpayers must be protected from initial costs as well as worst case scenarios, including by making the financial responsibility for project developers more robust and ensuring legal requirements about activity around the storage site applies to all entities, not just the project operator.

- CARB should not allow for geological storage projects to pull CO2 out of wells, nor should it allow any projects that have a cumulative net increase in CO2 when looking at full life cycle analysis. Furthermore, the program should not permit Bioenergy with Carbon Capture and Storage (BECCS), biomass carbon removal and storage (BiCRS), or offshore carbon dioxide injections, as bioenergy has substantial impacts to local air quality, health, and environmental justice, and offshore carbon dioxide injections pose significant risks and challenges which go beyond those associated with land-based carbon dioxide storage.

Critically, CARB must conduct an assessment of costs to consumers as well as potential public health impacts. In addition to the very real danger to human life, data shows that CCUS and Direct Air CCS projects are the most expensive way to address carbon issues.
