I’m concerned about the use of non-disclosure agreements between elected officials and corporations, and I would like you to take action to address this problem.

Companies have required NDAs that prevent local officials from informing the public about negotiations over the sale of their public water utility to corporations, about chicken and hog contracts with large agricultural companies, and about the land and water use of large industrial users, including data centers.

In Virginia, the country’s largest data center hub, researchers found that a staggering 25 out of 31 localities with existing data centers had signed NDAs with developers. In Montour County, Pennsylvania, where residents were able to ultimately block a data center proposal, officials were approached by Talon Energy to hold a meeting about rezoning, only to be told that they would need to sign a non-disclosure agreement and hide the details from their constituents in order to participate. More of these stories keep coming to light from the frontlines of data center fights across the country.

This tactic is also used by companies seeking to buy or lease public water systems. Private water companies will approach a municipality about selling their water system and use NDAs to keep the deal behind closed doors to avoid the inevitable public backlash.

Information is critical to protecting our communities. NDAs between government officials and private companies don’t benefit the public – they benefit the companies that stand to make a profit.

I urge you to support a blanket prohibition of non-disclosure agreements between elected officials, government officials, and private companies doing business with those entities.
